Civil and Commercial Arbitration

What is arbitration?

Arbitration is a dispute resolution process in which one or more arbitrators, chosen by the disputing parties or appointed by an arbitration institution, render a binding decision.

Unlike a court trial, arbitration is intended to be a faster, confidential, and often less expensive method of resolving disputes.

How does arbitration work?

1. Arbitration Agreement: It begins with an agreement between the parties to submit their dispute to arbitration. This agreement may be set out in an existing contract or formulated after the dispute arises.

2. Selection of Arbitrators: Based on the agreed terms, the parties select one or more neutral arbitrators with expertise in the relevant field.

3. Arbitration Procedure: The parties, assisted by their arbitrators, establish the schedule and rules for the arbitration procedure. They then present their evidence and arguments.

4. Arbitration Award: After reviewing the evidence provided by the parties, the arbitrators issue a final decision, called an arbitral award, which is binding and enforceable.
