The negotiation

Negotiation is one of the methods of conflict resolution by which the parties or their lawyers undertake a process to find a satisfactory negotiated solution to a conflict.

Facilitation during CRA

Thanks to my experience in civil and commercial litigation, I can support and facilitate reconciliation between the parties during conciliation (CRA), a private method of conflict resolution in which the conciliator, a judge appointed by the court in a judicial dispute, plays a passive role in the search for a negotiated solution.

The role of the negotiating lawyer is:

In the negotiation process, the negotiating lawyer acts in the sole interest of his client. He is not neutral.

  • To analyze the client’s file to identify the best negotiation approach
  • To assist the client in properly assessing their best alternative to settlement, including the costs and risks associated with their case
  • To make recommendations to the client regarding the appropriateness and terms of offers and counteroffers to be presented or accepted
  • Suggest creative and original solutions
  • Prepare and present settlement offers or counteroffers, whether in writing or during negotiation meetings
  • Draft and review settlement agreements to ensure they are enforceable
